What is Political Asylum?

Political asylum is a form of protection that allows people who have suffered persecution or fear persecution in their home country to remain legally in the United States.

Types of Asylum

Affirmative Asylum


  • Applied for through USCIS
  • Does not require being in deportation proceedings
  • Presented before an asylum officer

Defensive Asylum


  • Applied for before an immigration judge
  • Filed as a defense against deportation
  • Part of removal proceedings

Eligibility Requirements

To qualify for asylum, you must demonstrate persecution based on:

Important Deadline

You must file your application within one year of your arrival in the United States. Exceptions exist for extraordinary circumstances or changed country conditions.
